Defense Environmental Restoration Program (DERP) Annual Reports to Congress

Each year, the Department of Defense (DoD) submits an annual report to Congress (ARC) on its Defense Environmental Programs (DEP). The Report describes the Department’s accomplishments during the past year in its restoration, conservation, compliance, and pollution prevention programs by addressing plans and funding needs for protecting human health, sustaining the resources DoD holds in the public trust, meeting its environmental requirements, and supporting the military mission.

The information in this document was developed through a collaboration between the U.S. EPA (Subsurface Protection and Remediation Division, National Risk Management Research Laboratory, Robert S. Kerr Environmental Research Center, Ada, Oklahoma [SPRD]) and the U.S. Air Force (U.S. Air Force Center for Environmental Excellence, Brooks Air Force Base, Texas [AFCEE]). EPA staff were primarily responsible for development of the conceptual framework for the approach presented in this document; staff of the U.S. Air Force and their contractors also provided substantive input.

2012-06 Summary of CERCLA Cleanup Authorities and Provisions

The following sections of this report summarize the major cleanup authorities of CERCLA and other relevant provisions of the act. The topics discussed herein include the overall scope and reach of these statutory authorities, the process under which cleanup actions are selected and carried out at individual sites, the financial liability of potentially responsible parties for the costs of cleanup actions, the Superfund Trust Fund that may pay for cleanup actions when the potentially responsible parties cannot pay or cannot be found, enforcement of cleanup liability against the potentially responsible parties to minimize the need for federal tax revenues to finance the cleanup of contaminated sites, the applicability of CERCLA to federal facilities, and federal assistance for the cleanup of …
