2012-06 Summary of CERCLA Cleanup Authorities and Provisions

The following sections of this report summarize the major cleanup authorities of CERCLA and other relevant provisions of the act. The topics discussed herein include the overall scope and reach of these statutory authorities, the process under which cleanup actions are selected and carried out at individual sites, the financial liability of potentially responsible parties for the costs of cleanup actions, the Superfund Trust Fund that may pay for cleanup actions when the potentially responsible parties cannot pay or cannot be found, enforcement of cleanup liability against the potentially responsible parties to minimize the need for federal tax revenues to finance the cleanup of contaminated sites, the applicability of CERCLA to federal facilities, and federal assistance for the cleanup of …

This Guide to Preparing Superfund Proposed Plans, Records of Decision, and Other Remedy Selection Decision Documents (also commonly referred to as the “ROD Guidance”) has been developed to accomplish the following: • Provide recommended formats and content for Superfund remedial action decision documents; • Clarify roles and responsibilities of the U.S. Environmental Protection Agency (EPA), Federal facilities, States, and Indian Tribes in developing and issuing decision documents; • Clarify roles and responsibilities of stakeholders in the remedy selection process; and • Explain how to address changes made to proposed and selected remedies.

Final Report Of The Federal Facilities Environmental Restoration Dialogue Committee Consensus Principles And Recommendations For Improving Federal Facilities Cleanup

In 1992, the Federal Facilities Environmental Restoration Dialogue Committee (“the Committee”) was federally chartered under the U.S. Environmental Protection Agency (EPA) to address these and other issues. The goal of the Committee was to develop consensus policy recommendations aimed at improving the process by which federal facility environmental cleanup decisions are made, such that these decisions reflect the priorities and concerns of all stakeholders. This Final Report sets forth the Committee’s consensus recommendations.
