Updated Interim Guidance on Destruction or Disposal of Materials Containing Per-and Polyfluoroalkyl Substances in the United States

The Department of War (DoW) Per-and Polyfluoroalkyl Substances (PFAS) Task Force issues updated interim guidance to help DoW make informed decisions in the evaluation of existing destruction and disposal options for covered Do W PF AS-containing materials. This update takes into account new PF AS disposal and destruction information, including the U.S. Environmental Protection Agency (EPA) Interim Guidance on the Destruction and Disposal of Perfluoroalkyl and Polyfluoroalkyl Substances and Materials Containing Perfluoroalkyl and Polyfluoroalkyl Substances, April 8, 2024 (hereinafter referred to as the EPA 2024 guidance), section 330 of the FY 2020 National Defense Authorization Act (“NDAA”) (Public Law 11692), and section 324 of the FY 2026 NDAA (Public Law 119-60).

ASTSWMO Risk Mitigation Practices Fact Sheet

Risk mitigation practices (RMP) at Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) federal facility sites are critical for addressing environmental contamination efficiently and responsibly. These practices involve measures to mitigate risks posed by hazardous substances while long-term remediation plans are developed and implemented. Some examples discussed include access restrictions, interim land use controls, dig notifications, and public awareness. The purpose of this Fact Sheet is to help regulators identify when RMP should be considered to mitigate environmental impacts and to identify potential existing resources available. This Fact Sheet recommends regulators consider RMP at all federal facility CERCLA sites where such practices will reduce risk, prevent the continued migration of contamination, be cost effective, and help build community trust. The …

MEMORANDUM FOR ASSISTANT SECRETARY OF THE ARMY: Investigating Per- and Polyfluoroalkyl Substances within the Department of Defense Cleanup Program

The Department of Defense (DoD) conducts cleanup under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) and the Defense Environmental Restoration Program (DERP). Their goal is protection of human health and the environment in a risk-based, fiscally sound manner. This memorandum provides clarifying technical guidance on the investigation of per- and polyfluoroalkyl substances (PFAS) based on updated U.S. Environmental Protection Agency (EPA) information. This guidance is applicable to investigating these chemicals at Environmental Restoration Account-funded, Base Realignment and Closure Account-funded, and federal Air and Army Guard Operation and Maintenance account-funded sites.

Prioritization of Department of Defense Cleanup Actions to Implement the Federal Drinking Water Standards for Per- and Polyfluoroalkyl Substances

DoD Releases PFAS Cleanup Guidance:   The issuance of DoD’s memorandum, “Prioritization of Department of Defense Cleanup Actions to Implement the Federal Drinking Water Standards for Per- and Polyfluoroalkyl Substances Under the Defense Environmental Restoration Program,” describes DoD’s plans to incorporate the standards in EPA’s drinking water rule into DoD’s ongoing PFAS cleanups and prioritize actions to address private drinking water wells with the highest levels of PFAS from DoD activities.   https://www.acq.osd.mil/eie/eer/ecc/pfas/docs/policies/epa-mcl-implementation-memo.pdf

EPA Federal Facilities Superfund Program – RPM Bulletin 2024-02 Developing a Crosswalk between Legacy and PFAS Sites

The purpose of this document is to assist United States Environmental Protection Agency (EPA) Remedial Project Managers (RPMs) with the tracking of the location of per- and poly-fluoroalkyl substances (PFAS) with regard to “legacy” contaminants that have been historically addressed in the Superfund program. This is important because the presence of PFAS in the same location and media as legacy contaminants can affect protectiveness, as well as worker safety and remedy selection and function. This strategy will be useful at all phases of the Remedial Investigation, including Remedial Investigation Scoping, Conceptual Model development, sampling and data interpretation, remedy selection, and Federal Facility Superfund Sites’ Five-Year Reviews (FYRs). This Bulletin is providing recommendations that are consistent with existing guidance and identifies …

EPA Federal Facilities Superfund Program – RPM Bulletin 2024-01 Considerations When Reviewing PFAS in Five-Year Reviews

The purpose of this document is to assist United States Environmental Protection Agency (EPA) Remedial Project Managers (RPMs) when reviewing how per- and polyfluoroalkyl substances (PFAS) are addressed in Federal Facility Superfund Sites’ Five-Year Reviews (FYRs). This Bulletin is rooted in existing guidance and identifies best practices based on a review of how PFAS have been addressed in documents since 2020.
